Elizabeth Pascoe fails in her latest bid to stop Liverpool's Edge Lane scheme

This was her second legal challenge. The first CPO issued for the work was quashed in the High Court in November, 2006, on a technicality.

She fought the latest challenge on two grounds, first that reservations expressed by the Commission for Architecture and Built Environment (CABE) after a public inquiry had not been properly considered.

The second related to the inquiry inspector’s judgment (which was accepted by the Secretary of State) that alternative plans put forward by objectors were not deliverable.

Mr Justice Ouseley ruled against both of these, and said: “There was no error of law, no inadequacy of reasons and certainly no substantial prejudice was caused.”

Rob Monaghan, head of gateways, Liverpool Vision, said: “We are extremely pleased that the court has given this decision.”

HCA area director for Merseyside and Cheshire, Eliot Lewis-Ward, said: “The plans involve the comprehensive regeneration of the Edge Lane corridor, which will help to attract new jobs, provide good quality housing and new community facilities.”
