But he said Miss Ferguson failed to tell the school and her fitness was only discovered at a hearing months later.
He said this amounted to her “deliberately misleading the school regarding her absence.”
The hearing heard the school also discovered Ms Ferguson had signed a contract on October 19 with city recruitment agency Capita, despite being off work on paid sick leave.
The school only found out when Jim Jolley, headteacher of Anfield’s Pinehurst Primary School, contacted Mr Morgan to check on her status ahead of an intended interview.
Ms Ferguson claims she told a local educational authority occupational health officer of the doctor’s note on November 27.
The hearing heard that, although there is no mention of this in the official’s report it stresses Ms Ferguson felt well enough to return to work but was refusing to go back as “she feels unsafe”.
Mr Cookson said her stance was “incomprehensible” as her “allegations of bullying” had been investigated without substance.
