Liverpool Walton's Northcote Primary School right to dismiss assistant

A CITY school assistant who signed up to a jobs agency while receiving sick pay has lost her case for unfair dismissal.

Jeanette Ferguson, 41, was fired from Northcote Primary School, in Walton, for gross misconduct in October, 2008.

The tribunal heard her bosses only discovered she was fit to return to work nearly three months after her GP handed her a note giving her the all-clear after 14 months off with stress.

She also signed up to city jobs agency Capita while off sick.

Ms Ferguson claimed her sacking was down to headteacher Roy Morgan’s refusal to accept her role as a school Unison representative.

Rejecting her case, Tribunal Judge Dawn Shotter said her dismissal was fair and the result of “a full and objective investigation”.
