And, in his witness statement, he stressed: “It was not a simple judgment as to the severity of the child’s medical and social needs.

“But, using the expertise of the panel, the extent to which the college is the most suitable for the difficulties that would be caused to the child by moving to another school.”

Rejecting the father’s claim the appeals panel had failed to provide “clear and detailed” reasons on why his daughter had been rejected and something had “gone wrong in the appeals process”, Mr Justice Simon concluded: “The claim for judicial review must be dismissed.”

Mr Waszek said: “In the situation we were faced with, it would have been easy to roll over and award a place.

“But what would happen then is that word would go round that when someone takes legal action we’ll back down.”

He added: “There were 571 children and a lot of unsuccessful applicants.

“It is important that these parents are not disadvantaged just because someone waves a stick and has the means to go through with legal action.”

The ruling comes months after the Daily Post reported how a growing number of Liverpool parents were seeking legal help to secure their first- choice school.
