THE Scout Association lost an appeal against a ruling that it was liable for the injuries sustained by a boy during a game of “objects in the dark”.
Mark Barnes, now 23, from Castle Bromwich, West Midlands, was aged 13 when he was hurt in February, 2001, when playing the game with other scouts.
He was awarded £7,322 by a judge at Birmingham County Court in January this year. The association, concerned about the wider implications of the finding, took its case to the Court of Appeal but its challenge was dismissed by a two-to-one majority.
Mr Barnes injured his head and left shoulder.
